Terms of Use — Stride

1. Agreement to These Terms

These Terms of Use ("Terms") are a legally binding agreement between you and Stride ("Stride Labs, LLC," "Stride," "we," "our," or "us") governing your access to and use of the Stride mobile application, website at downloadstride.com, and any related services (collectively, the "Services").

By downloading, installing, or using the Services, you confirm that you are at least 13 years old (or the applicable minimum age in your country), that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree, do not use the Services.

If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.


2. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by updating the "Last Updated" date at the top of this page and, where appropriate, by sending a notice through the app or to your registered email address.

Your continued use of the Services after the updated Terms take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Services.


3. Eligibility

You may use the Services only if:

  • You are at least 13 years of age (or older if required by applicable law in your jurisdiction — residents of the EEA must be at least 16 years of age unless parental consent is provided)
  • You are not barred from using the Services under the laws of the United States or any other applicable jurisdiction
  • You have not previously been suspended or removed from the Services by us

The Services are not directed to children under the age of 13. If we learn that a user is under 13, we will terminate their account and delete their data.


4. Your Account

4.1 Account Creation

Certain features of the Services may require you to create an account. You may register using an email address and password or via Sign in with Apple. You agree to provide accurate, current, and complete information and to keep it updated.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@downloadstride.com if you become aware of any unauthorized access to or use of your account.

We are not liable for any loss or damage arising from your failure to maintain account security.

4.3 One Account Per Person

Accounts are personal to you and may not be shared with or transferred to another person without our written consent.


5. The Services

5.1 What Stride Does

Stride provides a workout planning and tracking platform for multi-sport athletes. Features include weekly training plan creation, session logging (sets, reps, weight, distance, pace), built-in workout timers, rest tracking, and progress history across sports including running, lifting, swimming, and cycling.

5.2 Subscriptions and Pricing

Stride offers a free tier with limited features. For full access to all features, you may purchase an optional paid subscription on a monthly or annual basis. Current pricing is displayed in the app at the time of purchase.

The annual subscription includes a 3-day free trial. If you do not cancel before the free trial ends, you will be charged the annual subscription price. You will not be charged during the free trial period.

Auto-Renewal: Subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.

Payment: Payment is charged to your Apple ID account at confirmation of purchase, or at the end of the free trial period for trial-eligible plans.

Cancellation: You may cancel your subscription at any time by going to Settings > [Your Name] > Subscriptions on your iOS device. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until that date. No refunds are provided for partial billing periods.

Price Changes: We reserve the right to change subscription pricing. We will provide reasonable advance notice of any price changes. Continued use of the paid Services after a price change takes effect constitutes your acceptance of the new price.

5.3 Availability

We strive to keep the Services available at all times but do not guarantee uninterrupted access. We may suspend or modify the Services at any time for maintenance, updates, or other operational reasons. We will try to provide advance notice of planned downtime where reasonably practicable.

5.4 Third-Party Integrations

The Services may integrate with third-party platforms, including the Health app. Your use of any third-party service is subject to that service's own terms and privacy policies. We are not responsible for the practices of third parties.


6. User Content

6.1 Your Content

"User Content" means any data, information, or content you submit to or create within the Services, including workout logs, training plans, exercises, sets, reps, distances, notes, and account profile information.

You retain all ownership rights in your User Content. By submitting User Content, you grant us a limited, worldwide, royalty-free, non-exclusive license to store, process, and display your User Content solely as necessary to provide the Services to you.

6.2 Aggregated Data

We may use de-identified, aggregated data derived from User Content (i.e., data that cannot reasonably be used to identify you) to improve the Services, conduct research, and generate analytics. This use does not affect your ownership of your User Content.

6.3 Your Responsibilities

You are solely responsible for your User Content. You represent and warrant that:

  • You own or have the necessary rights to submit your User Content
  • Your User Content does not violate any applicable law or these Terms
  • Your User Content does not infringe the intellectual property rights, privacy rights, or other rights of any third party

6.4 Content We May Remove

We reserve the right (but not the obligation) to review, edit, or remove any User Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.


7. Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Services in any way that violates applicable local, national, or international law or regulation
  • Attempt to gain unauthorized access to any part of the Services, other accounts, or systems connected to the Services
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Services
  • Scrape, crawl, or use automated means to access or collect data from the Services without our prior written consent
  • Upload or transmit viruses, malware, or any other harmful code
  • Use the Services to harass, abuse, or harm any person
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Remove, alter, or obscure any proprietary notices (including copyright and trademark notices) on the Services
  • Use the Services for commercial purposes without our prior written consent
  • Interfere with or disrupt the integrity or performance of the Services or the data contained therein

Violation of this section may result in immediate suspension or termination of your account.


8. Intellectual Property

8.1 Our IP

The Services, including all software, designs, text, graphics, logos, icons, images, audio clips, and underlying technology, are owned by or licensed to Stride and are protected by copyright, trademark, trade secret, and other intellectual property laws. The "Stride" name and logo are trademarks of Stride Labs, LLC.

These Terms do not grant you any right, title, or interest in the Services or our intellectual property. You may not use our trademarks, logos, or other proprietary materials without our prior written permission.

8.2 License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Stride iOS app on devices you own or control, solely for your personal, non-commercial use.

8.3 Feedback

If you submit ideas, suggestions, or other feedback about the Services ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, and incorporate that Feedback into the Services without any obligation to you.


9. Apple App Store Terms

The following terms apply because the Stride app is distributed through the Apple App Store:

  • These Terms are entered into between you and Stride, not Apple. Apple is not responsible for the Services or their content.
  • The license granted to you is limited to use on Apple-branded products that you own or control, as permitted by the App Store Usage Rules set forth in Apple's Terms of Service.
  • Apple has no obligation to provide maintenance or support for the Services.
  • In the event of any failure of the Services to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the Services.
  • Apple is not responsible for addressing any claims by you or any third party relating to the Services, including: (a) product liability claims; (b) any claim that the Services fail to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

10. Health & Fitness Disclaimer

Stride is not a medical device and does not provide medical advice. The Services are designed for general fitness tracking and training planning purposes only.

Nothing in the Services constitutes medical advice, diagnosis, or treatment. You should consult a qualified healthcare professional before beginning any exercise program or making changes to your existing training regimen, particularly if you have or suspect you may have any health condition.

By using the Services, you acknowledge and agree that:

  • Physical exercise involves inherent risks of injury
  • You are solely responsible for your workout choices and their physical consequences
  • Stride is not liable for any injury, illness, or other health outcome arising from your use of the Services

11. Termination

11.1 By You

You may stop using the Services at any time. To delete your account, go to Profile > Delete Account. Upon account deletion, your personal data will be handled in accordance with our Privacy Policy.

11.2 By Us

We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms or if continued access would expose us or others to legal risk or harm.

11.3 Effect of Termination

Upon termination, your license to use the Services ends immediately. Sections that by their nature should survive termination will survive, including Sections 6, 8, 10, 12, 13, and 14.


12. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, STRIDE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Services will be uninterrupted, error-free, or free of viruses or other harmful components
  • The results obtained from using the Services will be accurate or reliable
  • Any errors in the Services will be corrected

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.


13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, STRIDE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES.

IN NO EVENT SHALL STRIDE'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO STRIDE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

The limitations above apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if Stride has been advised of the possibility of such damages.

Some jurisdictions do not allow certain limitations of liability. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

Consumers in the EEA and UK: Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.


14. Indemnification

You agree to defend, indemnify, and hold harmless Stride and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Services
  • Your User Content
  • Your violation of these Terms
  • Your violation of any applicable law or the rights of any third party

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

15.2 Informal Resolution

Before filing any formal legal claim, you agree to first contact us at hello@downloadstride.com and attempt to resolve the dispute informally. We will try to resolve the dispute within 30 days of receiving your notice.

15.3 Jurisdiction

If a dispute is not resolved through informal negotiation, you agree to submit to the exclusive jurisdiction of the courts located in Florida.

15.4 EEA and UK Users

If you are a consumer resident in the EEA, you may also be entitled to bring a claim before the courts of your country of residence, and nothing in these Terms affects your rights under local mandatory consumer protection laws. The European Commission's Online Dispute Resolution platform is available at https://ec.europa.eu/consumers/odr.


16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Stride with respect to the Services and supersede all prior agreements and understandings.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Stride.

16.4 Assignment

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms freely, including in connection with a merger, acquisition, or sale of assets.

16.5 Force Majeure

We will not be liable for any delay or failure to perform our obligations under these Terms due to causes beyond our reasonable control, including natural disasters, acts of government, internet or infrastructure outages, or other force majeure events.

16.6 No Third-Party Beneficiaries

Except as expressly provided in Section 9 (Apple), these Terms do not create any third-party beneficiary rights.
